    Yes itís called eminent domain. This is not a new concept. Municipalities abuse it all the time for sure.

    If any of you are interested in the concept beyond a news article, read Kennedyís concurrence and Thomasí dissent in Kilo v. City. I find Thomasí dissent particularly compelling, but I also find most of his arguments compelling so perhaps Iím biased. Itís a fascinating case for anyone who is interested in con law or law in general.
